Hear to Hear (H2H) Website Terms of Use

1. NATURE OF THE PLATFORM
Heart to Heart ("H2H," "we," "our," or "us") operates solely as an online technology platform and marketplace that enables users to discover, connect with, and communicate with independent providers, including licensed professionals, coaches, mentors, consultants, educators, wellness professionals, and other service providers.
H2H does not provide healthcare services, medical services, psychotherapy, counseling, mental health treatment, psychiatric services, coaching services, consulting services, legal services, financial services, or any professional services.
H2H does not employ, supervise, direct, control, monitor, evaluate, endorse, certify, recommend, or guarantee any provider, provider qualifications, provider services, provider advice, provider conduct, or provider outcomes.
2. NO PROFESSIONAL RELATIONSHIP WITH H2H
Any relationship established through the Platform exists solely between the user and the provider.
Use of the Platform does not create any healthcare provider-patient relationship, therapist-client relationship, coaching relationship, attorney-client relationship, fiduciary relationship, or other professional relationship with H2H.
3. NOT MEDICAL OR MENTAL HEALTH ADVICE
Information available through the Platform is provided for informational purposes only.
Nothing on the Platform constitutes medical advice, mental health advice, psychotherapy, diagnosis, treatment, legal advice, financial advice, or professional advice of any kind.
4. EMERGENCY DISCLAIMER
H2H is not an emergency service, crisis hotline, suicide prevention service, emergency response provider, or crisis intervention provider.
H2H does not monitor communications for emergencies.
If you are experiencing a medical emergency, psychiatric emergency, mental health crisis, suicidal thoughts, risk of self-harm, risk of harm to others, or any emergency situation, call 911,
contact emergency services, go to the nearest emergency room, or contact an appropriate crisis hotline immediately.
H2H does not verify whether a provider is appropriate for a user's specific circumstances. Users are solely responsible for determining whether a provider is appropriate for their needs.
5. PROVIDER INFORMATION
Provider profiles, biographies, credentials, certifications, qualifications, licenses, descriptions, testimonials, and other information are supplied by providers.
H2H does not guarantee the accuracy, completeness, validity, legality, quality, competency, licensing status, certifications, experience, or qualifications of any provider.
Users are solely responsible for evaluating providers.
6. NO GUARANTEE OF RESULTS
H2H makes no guarantees regarding provider availability, provider qualifications, provider performance, user satisfaction, outcomes, business opportunities, or results.
7. PAYMENTS AND TRANSACTIONS
Unless expressly stated otherwise, H2H is not a party to transactions between users and providers.
Providers are solely responsible for establishing fees, collecting payments, issuing refunds, handling cancellations, resolving disputes, and delivering services.
8. USER RESPONSIBILITIES
Users agree to provide accurate information, comply with applicable laws, use the Platform only for lawful purposes, refrain from harassment or abuse, and independently evaluate providers.
8.1 USER ELIGIBILITY
You must be at least eighteen (18) years of age to access or use the Platform.
By using the Platform, you represent and warrant that you are at least eighteen (18) years old and legally capable of entering into binding agreements.
9. COMMUNICATIONS
The Platform may provide communication tools, inquiry forms, messaging tools, email services, scheduling tools, or video conferencing integrations.
H2H does not monitor, review, supervise, record, or control communications between users and providers.
9.1 RELIANCE ON PROVIDERS
Users acknowledge that decisions, actions, advice, coaching, counseling, consulting, mentorship, educational services, wellness services, or other services provided by a provider are solely the responsibility of the user and provider.
H2H shall not be responsible for any decision made based on information obtained through a provider.
9.2 ACCOUNT SECURITY
Users are responsible for maintaining account security and confidentiality of login credentials. 10. PLATFORM AVAILABILITY
H2H does not guarantee uninterrupted access to the Platform.
11. THIRD-PARTY SERVICES
The Platform may contain links to or integrations with third-party services. H2H does not control and is not responsible for third-party services.
12. PRIVACY AND DATA USE
H2H respects user privacy and is committed to protecting personal information.
H2H does not sell users' personal information, personal data, contact information, inquiry information, provider information, or communications to third parties for monetary compensation.
H2H does not share personal information with third parties for their own independent marketing purposes.
Information may be collected, used, stored, and disclosed as described in H2H's Privacy Policy. 13. INTELLECTUAL PROPERTY
All Platform content, trademarks, logos, branding, software, designs, graphics, text, functionality, and materials are owned by H2H or its licensors.
14. COPYRIGHT COMPLAINTS
H2H reserves the right to remove allegedly infringing content and terminate repeat infringers. 15. RESERVATION OF RIGHTS
H2H reserves all rights not expressly granted under these Terms.
16. DISCLAIMER OF WARRANTIES
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."
17. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, H2H'S TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
18. INDEMNIFICATION
Users agree to indemnify, defend, and hold harmless H2H from claims arising from use of the Platform or interactions with providers.
19. TERMINATION
H2H may suspend or terminate access to the Platform at any time.
20. ARBITRATION; JURY WAIVER; CLASS ACTION WAIVER
All disputes shall be resolved through binding arbitration in New York, New York. Users waive jury trial rights and class action rights.
21. FORCE MAJEURE
H2H shall not be liable for failures caused by events beyond its reasonable control. 22. GOVERNING LAW
These Terms shall be governed by the laws of the State of New York.
23. SEVERABILITY
If any provision is found unenforceable, the remainder shall remain in effect. 24. CHANGES TO THESE TERMS
H2H may modify these Terms at any time.
